If you are interested in asking us to represent you (the “Services”), please call us, email us, or otherwise contact us so we can determine whether the matter is one for which we are willing or able to accept professional responsibility.  The telephone numbers and other contact information for our offices are listed on our Website.  If you submit information to us by email or otherwise, you acknowledge that it will not be considered to be confidential absent an express written agreement by Lavelle Law to maintain your information in confidence.  We reserve the right to decline any representation, and may be required to decline representation if it would create a conflict of interest with any of our current or former clients.   


The hiring of a lawyer is an important decision that should not be based solely upon advertisements. Before you decide, ask us to send you free written information about our qualifications, practice groups, and experience.


Use of Website Represents Acceptance. These Terms and Conditions of Use constitutes a binding and enforceable agreement between you (individually and in your individual capacity as an employee, officer, agent, partner, etc. of each organization you represent in connection with any use of the Website) and Lavelle Law. By using any Website or any Services, you acknowledge and agree that you have fully read and agree to be bound by the provisions of the Terms, exactly as if it were printed on paper and signed by you. If you do not agree to be bound by the Terms in its entirety, then you must immediately stop using the Website and all Services. Although the registration process may require you to "click-through" or otherwise affirmatively agree to be bound by the provisions of the Terms, the Terms are binding on you by your use of any Website or Services, regardless of whether or not you choose to register.


Business or Employment Use. AGGREGATE LIABILITY. These Terms and Conditions of Use become effective upon your first time accessing the Website and are effective unless and until terminated pursuant to the terms hereof or by either you or Lavelle Law in writing. You may terminate these Terms and Conditions of Use at any time, provided that you immediately discontinue any further use of the Website. Lavelle Law may terminate these Terms and Conditions of Use, in our sole discretion, at any time and may do so immediately without notice, without explanation, at any time, and accordingly deny you access to the Website. Upon any termination of these Terms and Conditions of Use by either you or Lavelle Law, you must promptly destroy all materials downloaded or otherwise obtained from the Website, as well as all copies of such materials, whether made under these Terms and Conditions of Use or otherwise. Without limiting Lavelle Law’s other remedies, it may temporarily or indefinitely suspend or permanently revoke your access to the Website if: (a) you breach the letter or spirit of any Terms and Conditions of Use; (b) Lavelle Law suspects or becomes aware that you have provided false or misleading information to Lavelle Law, any attorney, any staff, or any user; (c) Lavelle Law believes, in its sole discretion, that your actions may cause legal liability for you, any users, or Lavelle Law, its attorneys, its staff, or its affiliates; may be contrary to the interests of the Website or Lavelle Law; or may involve illicit activity; or (d) Lavelle Law otherwise reasonably determines that doing so is in the best interests of Lavelle Law and/or its users. 


Without limiting Lavelle Law’s other remedies, if you engage in actions or activities that damage the Website, you must pay Lavelle Law for all amounts owed to Lavelle Law and reimburse Lavelle Law for all losses and costs (including any and all time incurred by attorneys, staff, employees, vendors, and contractors of Lavelle Law) and reasonable expenses (including attorneys’ fees) related to investigating such actions, repairing the Website, and enforcing Lavelle Law’s rights. In addition, violations of the Terms may be prosecuted to the fullest extent permitted by the law and may result in additional penalties and sanctions.


Miscellaneous


Representations and Warranties. You represent and warrant that you: (i) have full authority and all rights necessary to enter into and fully perform all of your obligations pursuant to these Terms and Conditions of Use; (ii) have not and will not enter into any agreement or perform any act that might contravene the purposes and/or effects of these Terms and Conditions of Use; and (iii) will not delete any Content.


Jurisdiction. The Terms will be governed by the laws of the State of Illinois, without regard to its rules of conflict of laws. The state and federal courts located in Cook County, Illinois, will have exclusive jurisdiction over any case or controversy arising from or relating to the Terms, the Website or any Services. You hereby consent irrevocably to personal jurisdiction in such courts with respect to any and all such matters, and waive any defense of forum non conveniens with respect to such courts. Notwithstanding the foregoing, Lavelle Law may seek appropriate injunctive relief from any court having jurisdiction. You hereby do knowingly and voluntarily waive any right to a trial by jury in any case or controversy arising from or relating to the Terms.


Assignment. Your rights and obligations under the Terms are personal to you and may not be assigned to any other party. Lavelle Law may assign its rights and obligations hereunder to any party or entity without any party’s consent.  All your obligations and duties under the Terms shall be binding on all successors in interest and assigns.


Force Majeure. Neither Lavelle Law nor any entity that is part of Lavelle Law will be deemed to be in breach of the Terms for any failure or delay in performance caused by reasons beyond its reasonable control, including any natural calamity, act of God or a public enemy, act of any military, civil or regulatory authority, change in any law or regulation, disruption or outage of communications, health epidemic, government shutdown or closing, power outage, or other failure to perform by any supplier or other third party, or any other cause beyond the reasonable control of Lavelle Law.


Waiver. Lavelle Law will not be deemed to have waived any breach by you of the Terms, except by a written waiver expressly so stating, and such waiver will not be construed as a waiver of subsequent or continued breaches.


No Agency. You are not an agent, representative, or partner of Lavelle Law, nor are you able to bind Lavelle Law. You and Lavelle Law are independent contractors and the Terms shall not be interpreted or construed to create an association, agency, joint venture, or partnership between you and Lavelle Law.


Severability. If any provision of the Terms are held to be invalid or unenforceable, such invalidity or unenforceability will be limited to the maximum extent permissible, and the other provisions of the Terms will remain in full force and effect.


Complete Understanding. The Terms constitute the final and complete agreement between the parties regarding the subject matter hereof, and supersedes any prior or contemporaneous communications, representations or agreements between the parties relating to the subject matter hereof.


Survival. The rights and obligations of a user, that by their nature would continue beyond the expiration or termination of the Terms, including without limitation representations and warranties, indemnifications, and limitations of liability, shall survive termination or expiration of the Terms.
